We include preparation and service by professional process servers of all necessary notices as well as prejudgment claim forms
Although there are a lot of resources out there to help landlords with initial notices, most of the notices that people serve to their tenants are in fact, fatally flawed for court purposes. We prepare clerically sound notices specifically for the particulars of your unique eviction situation. Whatever notices fit your situation are prepared and served to your tenants as part of your package fee.
We will also serve the court documents for you.
Our eviction package includes process service to all of your tenants by our registered and bonded process servers and serve a prejudgment claim form to all tenants. we maintain a statewide network of registered process servers.
What is a prejudgment claim of right to possession?
This is very valuable addition to your eviction case! If you think there may be people that are not named on the rental agreement or lease residing in the property, they typically would not be included on the court documents that order the Sheriff to evict the occupants. We include this document as a standard part of our package. If there are other people living in your property in any capacity, whether you know their names or not, this document will make it so that everyone in the property will be removed by the Sheriff. This is the only way to address any unknown persons on the property. With the pre-judgment claim, when we get the writ for eviction from the court, it will apply to "any and all occupants" that may be in the property.
What about Attorney Representation?
We do have attorney representation available when the circumstances warrant. For example if the property you are evicting your tenants from is owned by Corporation, Trust, L.L.C. or other entity, then attorney representation is required by law. In the event that your tenants file an answer to the complaint filed with the court, we will send one of our attorney partners to the resulting hearing to represent you. This is an additional service and additional fees will apply. Charges for additional hearings will be separate and based on the attorneys going rate, however are attorney's rates are very inexpensive and also based on flat work fees.
Trust us and the process, and let us do the work for you. It's our job! Most of the time, the eviction process takes about three to six weeks to complete, but it varies depending on the situation. As we work within the parameters of the California Legal System, we cannot guarantee time frames, however when there is action for us to take we do so immediately to expedite the processing of your case. Our staff has worked with thousands of property owners for the past 6 years and we have experienced it all up close and personal. We will get you possession of your property.
